Since her first bar admission in 1986, Ruth Liebesman has handled criminal cases States of New York and New Jersey, and in the Commonwealth of Massachusetts, including trying cases in which the defendants were charged with murder, attempted murder, robbery, gang assault, sexual assault and arson.
Ruth recently obtained her second hung jury in case charging a particularly heinous assault. After the second hung jury, Ruth successfully moved to have all charges permanently dismissed.
After a person has been convicted after trial or in a plea agreement, he or she may seek to have a higher court rule that the conviction was not lawful. Ruth has handled a number of state court appeals.
While an appeal addresses matters that occurred during the hearings or trial, a Motion for Post Conviction Relief, or a Motion to Vacate Judgment, addresses matters not “on the record,” such as newly discovered evidence, evidence hidden by the prosecutor, or the trial lawyer’s failure to investigate exculpatory evidence. Ruth Liebesman has filed a number of these Petitions, including the successful Motion to Vacate Judgment in People v. Correa, in which the defendant was released from prison on Christmas Eve after serving 10 years for murder he did not commit.
